The terms on which you may use this website, submit a booking request, and register with us as a dental professional.

  • Using this website means you accept these terms.
  • Submitting the booking form is a request, not a confirmed booking. Cover is confirmed once we send you a written confirmation.
  • The commercial detail of any placement — rates, charges, cancellation and transfer fees — sits in our Terms of Business, which we provide before we supply anyone.
  • Registering with us doesn’t guarantee work, and we can’t guarantee a particular locum will be available.
  • Nothing on this site is clinical, legal, tax or employment advice.

About these terms

These Terms of Service govern your use of opaldentallocums.com and any request, enquiry or registration you submit through it. By using the site or submitting a form, you confirm that you accept these terms and agree to comply with them. If you do not accept them, please do not use the site.

These terms sit alongside two other documents, which are part of the same agreement:

  • Our Privacy Policy, which explains how we handle personal information.
  • Our Cookie Policy, which explains the cookies this site uses.

If you engage us to supply staff, our Terms of Business for the Supply of Temporary Workers will also apply. Those terms are provided separately and, where they conflict with anything on this page, they take priority in relation to the supply of staff.

We operate as an employment business and an employment agency within the meaning of the Employment Agencies Act 1973, and we comply with the Conduct of Employment Agencies and Employment Businesses Regulations 2003.

Using this website

We make this site available free of charge. We do not guarantee that it, or any content on it, will always be available or uninterrupted, and we may suspend, withdraw or restrict all or part of it for business or operational reasons without notice.

You are responsible for making the arrangements necessary to access the site, and for ensuring that everyone who accesses it through your internet connection is aware of these terms and complies with them.

The site is directed at people in the United Kingdom. We make no representation that the content is appropriate or available in other locations.

Acceptable use

You may use this site only for lawful purposes. You must not:

  • Use the site in any way that breaches applicable law or regulation, or that is fraudulent or has a fraudulent purpose or effect.
  • Submit false, misleading or impersonating information, including false qualifications, registration details or right-to-work evidence.
  • Submit booking requests you do not genuinely intend to proceed with.
  • Transmit any material that is defamatory, obscene, offensive, or that infringes anyone’s rights.
  • Introduce viruses, trojans, worms, logic bombs or other malicious material.
  • Attempt to gain unauthorised access to the site, the server on which it is stored, or any connected database.
  • Scrape, harvest, data-mine or systematically extract content, including candidate or vacancy information, whether by automated means or otherwise.
  • Use the site to send unsolicited commercial communications, or to advertise a competing service.
  • Attack the site by means of a denial-of-service attack.

We may withdraw your right to use the site, and report any breach to the relevant law enforcement authorities, if you fail to comply with this section.

Intellectual property

We own or are licensed to use all intellectual property rights in this site and the material published on it, including the Opal Dental Locums name, logo, text, graphics, photographs, layout and design. These works are protected by copyright, trade mark and other laws.

You may print off one copy and download extracts of any page for your own use, and you may draw the attention of colleagues to content on the site. You must not modify copies of any materials, use any illustrations, photographs or graphics separately from the accompanying text, or use any part of the content for commercial purposes without a licence from us. Our status as authors must always be acknowledged.

Any third-party trade marks, logos or content appearing on the site remain the property of their respective owners.

Booking requests from practices

The booking form on this site allows a dental practice to request locum cover. Please note:

  • A submitted form is a request, not a booking. It does not create a binding contract and does not reserve a member of staff.
  • A booking is only confirmed when we send you a written confirmation, by email or through our system, setting out the role, date, times and charge rate.
  • By submitting a request you confirm that you are authorised to make bookings on behalf of the practice named, and that the information you have given is accurate.
  • We will use the contact details you provide to respond to the request and to manage the booking.
  • We may decline a request, and we are not obliged to give a reason.

If we are unable to fill a booking, we will tell you as soon as we reasonably can. We cannot guarantee that cover will be available for any particular date, role or specialism, and we are not liable for losses arising from a booking we are unable to fill.

Supply of locum staff

Where we supply a locum to your practice, that supply is governed by our Terms of Business, which we will send you before or at the point of the first booking. In summary, and subject always to those terms:

  • We vet the professionals we supply, including verifying identity and right to work, GDC registration where applicable, qualifications, references and DBS status. We supply staff we reasonably believe to be suitable based on the requirements you give us.
  • The practice remains responsible for the locum’s day-to-day supervision, direction and control while on assignment, and for the clinical governance, health and safety, infection control, indemnity arrangements, equipment and induction applying at your premises.
  • The practice must give us accurate information about the role, including any specialist skills, risks or qualifications required, and must tell us promptly if the requirements change.
  • Locums supplied by us are not employees or workers of the practice, and the practice must not treat them as such without agreeing that separately with us.
  • Practices must not engage a locum introduced by us directly, or through another agency, without first paying any applicable transfer fee or serving the extended hire period set out in our Terms of Business.
  • The practice must confirm hours worked, normally by approving a timesheet, promptly and accurately.

Charges and payment

Charge rates are agreed for each booking and confirmed in writing. Rates vary by role, location, notice period, day of the week and time of day.

  • Charges are calculated on the hours confirmed by the practice, and are payable whether or not the practice makes full use of the locum’s time.
  • Invoices are issued weekly and payable within 14 days of the invoice date.
  • All charges are exclusive of VAT, which is added where applicable.
  • We may charge interest and compensation on late payment under the Late Payment of Commercial Debts (Interest) Act 1998.
  • Transfer fees, extended hire options and permanent placement fees are set out in our Terms of Business.

Nothing on this website constitutes a quotation. Indicative figures are not binding until confirmed in writing.

Changes and cancellations

We understand that practice schedules change. So that we can treat our locums fairly, cancellations are subject to notice periods:

  • Cancellations must be made in writing to Bookings@odlocums.com or by telephone, followed up in writing.
  • A confirmed booking cancelled with less than 24 hours’ notice may be charged in full, as set out in our Terms of Business.
  • If a locum is sent home early, or the practice closes on the day, the full confirmed hours remain chargeable.
  • If a locum cannot attend, we will do everything we reasonably can to provide a replacement. If we cannot, you will not be charged for that booking.

Registering as a dental professional

If you register with us or apply for a role, you agree that:

  • All information you provide — including your identity, GDC registration, qualifications, immunisation status, DBS status, right to work and employment history — is true, accurate and complete, and you will tell us promptly if anything changes.
  • You will provide the documents we need to complete our vetting checks, and you understand we cannot place you until those checks are complete.
  • You hold and maintain valid professional indemnity cover as required for your role, or agree the position with us in writing.
  • You will notify us immediately of any GDC investigation, condition, suspension or erasure, any criminal charge or conviction, or anything else that affects your fitness to practise.
  • Registering with us does not guarantee any work, and does not create an employment contract. Each assignment is offered and accepted separately.
  • You will comply with the policies, procedures and clinical governance of any practice you are placed in, arrive on time, and tell us as early as possible if you cannot attend a confirmed shift.
  • You will not seek to be engaged directly by a practice we introduced you to in a way that circumvents our agreement with that practice.

We may decline to register you, or end our relationship with you, if we reasonably consider you unsuitable for the assignments we supply.

This site links to third-party websites and services, including our jobs hub hosted at hub.rocket-recruitment.co.uk and our social media pages. Those links are provided for your information only. We have no control over the content of those sites and accept no responsibility for them, for any loss arising from your use of them, or for their privacy practices. Their own terms and privacy notices will apply.

Accuracy and availability

The content on this site is provided for general information only. It is not advice — clinical, legal, tax, employment or otherwise — and you should not rely on it as such. If you need advice on a specific situation, please speak to a suitably qualified professional.

Our liability

Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be limited or excluded.

Subject to that:

  • We exclude all implied conditions, warranties and representations relating to this site and its content to the fullest extent permitted by law.
  • We will not be liable for any loss of profit, loss of business, business interruption, loss of anticipated savings, loss of goodwill, or any indirect or consequential loss, arising from your use of, or inability to use, this site.
  • Our total liability arising in connection with your use of this website is limited to £1,000.
  • Our liability in connection with the supply of staff is set out in our Terms of Business and is normally capped by reference to the charges paid for the relevant booking.

If you are a consumer rather than a business, these limits apply only to the extent permitted by law, and your statutory rights are not affected.

We process personal information in accordance with our Privacy Policy. This site uses cookies as described in our Cookie Policy. By submitting a form on this site you confirm you have read our Privacy Policy.

Changes to these terms

We may amend these terms at any time by updating this page. Please check it each time you use the site. The version in force is the one published here on the date you use the site. Changes do not affect bookings already confirmed, which remain governed by the terms in force when they were confirmed.

Complaints, law and jurisdiction

If something has gone wrong, please tell us. We take complaints seriously and aim to acknowledge them within 2 working days and resolve them within 10 working days.

These terms, their subject matter and their formation are governed by the law of England and Wales. The courts of England and Wales have exclusive jurisdiction over any dispute, except that if you are a consumer resident in Scotland or Northern Ireland you may also bring proceedings in your home courts.

A person who is not a party to these terms has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any of them.
